Terms & Conditions - Trader Insight

1. Acceptance of Terms

By downloading, installing, or using the Trader Insight mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you ("User") and Trader Insight ("we", "us", "our", "Company", "App Creator", "Founder").

2. Nature of the App

Trader Insight is a personal trade journaling and analytics tool designed to help users track, analyze, and review their trading activities. The App provides statistical insights, AI-powered analysis, performance metrics, and data visualization features. THE APP IS NOT A FINANCIAL ADVISORY SERVICE. Nothing in this App constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All information provided by the App, including but not limited to AI Insights, Monte Carlo simulations, statistical analyses, win/loss probabilities, performance trends, association rules, regression analyses, and any other analytical output, is for informational and educational purposes only.

3. No Financial Advice Disclaimer

IMPORTANT: Please read this section carefully. a) The App does NOT provide financial advice, investment recommendations, or trading signals. b) All insights, analytics, projections, and statistical outputs generated by the App (including but not limited to Monte Carlo simulations, Bayesian probability estimates, performance trend analyses, symbol correlation data, and regression results) are based solely on the user's own historical data and statistical models. These outputs are NOT predictions of future performance and should NOT be relied upon for making financial decisions. c) Past performance, whether actual or simulated, does NOT guarantee or indicate future results. d) Always DO YOUR OWN RESEARCH (DYOR) before making any trading or investment decision. e) We strongly recommend consulting a SEBI-registered investment advisor or qualified financial professional before making any investment or trading decisions. f) Trading in securities, derivatives, and other financial instruments involves substantial risk of loss and is not suitable for every investor. You should carefully consider whether trading is appropriate for you in light of your financial condition and risk appetite.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: a) The App Creator, Founder, Company, its directors, officers, employees, affiliates, agents, contractors, and licensors (collectively "Indemnified Parties") shall NOT be held liable, responsible, or accountable for any losses, damages, or expenses of any kind (including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages) arising from or in connection with the use of this App. b) The Indemnified Parties are fully exonerated from any and all liability related to: - Financial losses incurred from trading or investment decisions - Losses arising from reliance on any information, insight, or analysis provided by the App - Losses due to incorrect data entry by the user - Technical errors, bugs, or interruptions in the App - Any decision made based on the App's analytical outputs c) You acknowledge and agree that you use this App entirely at your own risk. The Company and its Founder are NOT liable for any kind of financial losses, trading losses, capital losses, opportunity losses, or any other losses that you may suffer from using this App. d) Under no circumstances shall the Company's total liability to you exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

5. Indemnification

You agree to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all claims, demands, actions, losses, damages, costs, and expenses (including reasonable legal fees) arising from: a) Your use or misuse of the App b) Any trading or investment decisions you make c) Your violation of these Terms d) Your violation of any applicable law or regulation e) Any claim that your use of the App caused damage to a third party

6. Subscription & Payments

a) The App offers both free and premium subscription plans. Premium features are accessible only through active paid subscriptions. b) Subscription payments are processed through Google Play Store and/or Apple App Store. All payments are subject to the respective store's payment terms and conditions. c) Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through the respective app store. d) Refund requests are subject to the refund policies of Google Play Store or Apple App Store. We do not process refunds directly. e) We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect active subscription periods. f) Subscription fees are non-refundable for any financial losses you incur while using the App.

7. User Responsibilities

a) You are solely responsible for the accuracy of data you enter into the App. b) You are responsible for maintaining the confidentiality of your account and PIN. c) You must be at least 18 years of age to use this App. d) You must comply with all applicable laws and regulations, including SEBI regulations, Income Tax Act, FEMA, and other relevant Indian laws when trading in securities. e) You acknowledge that you understand the risks associated with trading and investing in financial markets.

8. Intellectual Property

All content, features, and functionality of the App (including but not limited to text, graphics, logos, icons, algorithms, analytics engines, and software) are owned by the Company and are protected by Indian and international copyright, trademark, and intellectual property laws.

9. Data Storage & Security

a) All your trade data is stored locally on your device. We do not store your personal trading data on our servers. b) We are not responsible for data loss due to device malfunction, app uninstallation, or any other reason. Users are advised to regularly export/backup their data. c) The App provides optional security features (PIN, biometric lock) for additional protection.

10. Governing Law & Jurisdiction

a) These Terms shall be governed by and construed in accordance with the laws of the Republic of India. b) Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts in India. c) For users outside India, these Terms shall still be governed by Indian law, and Indian courts shall have exclusive jurisdiction.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will make reasonable efforts to notify users of significant changes through the App.
